Real Estate Media Terms of Service

By booking or using services provided by wSinger Media, the client agrees to the following Terms of Service.

1. Services Provided

• We provide real estate photography, videography, and related media services for marketing and promotional use of properties.

2. Booking & Payment

• Payment is due before service is started.

• Late payments may result in delayed delivery or additional fees.

• All prices are subject to change until a booking is confirmed.

3. Cancellations, Rescheduling, & Return Visits

• Cancellations or rescheduling must be made at least [48] hours before the scheduled shoot.

• Cancellations made within [48] hours may be subject to a cancellation fee of [$100].

• Return visits may incur extra fees up to [$200] decided at our discretion.

• Weather-related rescheduling and return visits (especially for exterior shoots) will be handled at our discretion for safety and quality reasons, no fee will apply.

4. Property Access & Preparation

• The Client is responsible for ensuring the property is accessible at the scheduled time and ready to be photographed or filmed.

• We are not responsible for missed shots or reduced quality due to clutter, poor lighting, restricted access, or unprepared spaces.

• Return visits (if filming has already happened) may incur extra fees up to [$200] decided at our discretion.       (As stated in section 3 of wSinger Media's, Real Estate Terms of Service)

5. Creative Discretion & Revisions

We retain creative control over shooting style, angles, lighting, editing, and final presentation. Requests for specific styles must be communicated before the shoot. Minor revisions may be offered at our discretion; extensive revisions may incur additional charges up to [$100].

6. Delivery & Turnaround

• Typical turnaround time is [1-7 days], unless otherwise agreed.

• Delivery timelines are estimates and not guaranteed, especially during peak seasons or due to unforeseen circumstances.

7. Usage Rights & Licensing

• Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property photographed or filmed.

• Media may not be sold, transferred, reused for another property, or used by third parties without written permission.

• We retain full copyright ownership of all media

8. Portfolio & Promotional Use

We reserve the right to use completed work for our portfolio, website, social media, advertising, and other promotional purposes unless otherwise agreed in writing prior to the shoot.

9. Drone Services (If Applicable)

• Drone operations are subject to FAA regulations, weather conditions, airspace restrictions, and safety considerations.

• We reserve the right to cancel or modify drone services if conditions are unsafe or illegal.

• The Client is responsible for obtaining any required permissions from property owners, HOAs, or municipalities unless otherwise agreed.

10. Liability & Indemnification

• We are not responsible for damage to property, loss, or injury unless caused by gross negligence.

• The Client agrees to indemnify and hold us harmless from any claims arising from unauthorized use of media or lack of permissions related to the property.

11. Force Majeure

We are not liable for failure or delay in performance due to events beyond our control, including but not limited to weather, illness, equipment failure, acts of God, or government restrictions.

12. Refund Policy

Due to the custom nature of photography and videography services, no refunds are provided once services have been started. Exceptions may be made at our sole discretion.

13. Acceptance

By booking services or using delivered media, the Client acknowledges they have read, understood, and agreed to these Terms of Service.
